I’m in favor of a universal right to seek an abortion through the 1st trimester, with exceptions that allow you to terminate further into the pregnancy such as major congenital issues or risk to the life of the mother, but Roe v. Wade has never sat with me well because it was never really based on solid constitutional ground, and I believe there have been other rulings where the same logic (that the privacy clause in the due process section of the 14th Amendment protects a right to abortion) was not applied, leading me to believe it was a contrived excuse.
So with that being said, I’m seeing basically this exact dumb take being repeated by leftist pundits all over twitter, and I just have to roll my eyes. It may be the case that some of these laws are equally unpopular with conservatives, but you’re on much more solid legal footing when you say the Equal Protection clause of the 14th Amendment means you can’t discriminate against gay people than when you say the privacy clause means women can’t be stopped from seeking abortions. Obergefell isn’t getting overturned.
