I could be wrong, but I think the problem with AI art won't be solved by arguing endlessly over whether it is or not "real art" or "has soul" or is more or less derivative that regular art, because it's a borderline metaphysical question that's going to be very hard to answer properly.
On the other hand, saying that it's built over the work of millions of unpaid and uncredited artists who never consented to have their art sucked up by some neural network is a cold hard fact, it's demonstrable, and that's how we have a chance of cutting through that legal grey area.
