With the other, rather than simply holding someone liable for deliberately hosting child abuse photos, it creates a censorship board which can go around taking down content they don't like (no judicial decisions required).

Such a board would be very susceptible to abuse and over-reach.

This bill would also make services (who might be very small) vulnerable to legal harassment from bad actors (such as certain religiously motivated American ones).

Given that services don't really want this kind of content on their services, it's not clear whether they'd moderate better with other provisions of this bill, or whether they'd do whatever they can to "do something" (even if that something is harmful).

The first one, EARN IT, has made appearances before. It threatens to undermine privacy by making internet service providers search through private messages (including in encrypted messages, effectively banning E2EE) for illegal content.

It is also a threat to freedom of expression and people's trust in services.

From an ethical perspective, this is terrifying. This is information which a patient entrusts in confidence that it won't end up in some strange place, whether with a researcher, a tech firm, or a criminal (a centralized store could be breached).

I'm scared the Digital Services Act (DSA) will be used as a tool to censor porn or other sexual expression (especially, in the midst of an infinitely dumb, yet utterly predictable moral panic).
