discriminated against based on what? there is no right to "use bathroom you feel most comfortable in". bathrooms aren't segregated by sex to affirm people. they're segregated by sex to protect women from men, feminists fought for them so women could exist with less fear in the public space. and making bathrooms gender neutral has been shown to increase incidents of sexual predation and violence against women.

but why not extend that courtesy to cis men and allow them in women's bathrooms, if they're innocent? also if there were any trans activists saying transwomen convicted of rape and violent crime against women shouldn't be allowed in womens' spaces exist I'd be pleasantly surprised. they aren't because that's not the right they are fighting for. the "right" they are fighting for is the affirmation of personal identity
