In U.S. v. Skrmetti, the case about tennessee's gender affirming care ban, the DOJ is arguing that the Equal Protection Clause protects trans people, including trans kids seeking gender affirming care.
I've seen people saying on social media that Dems don't care about trans rights. Or that Kamala Harris doesn't care. While Democrats could be doing better— including talking about the landmark argument that the equal protection clause protects trans —they're not doing nothing! #scotus #uspol
When I posted this toot yesterday (it's gonna take a while to get used to using the word toot) I hadn't even yet read the horseshit that the nation published yesterday. Mylanta.
there are so many factual errors in this piece— starting with the case name—it's embarrassing that the editors over there published it https://www.thenation.com/article/politics/kamala-harris-trans-rights-platform/
Also, the Biden administration is currently being blocked from enforcing new title IX rules that protect trans students. If Trump wins, Title IX won’t protect trans students anymore. They’ll just write new rules.
It’s so incredibly dangerous for people to be spreading the lie that the Biden administration is doing nothing for trans people.
And while trans people may not be put in physical detention camps, many will be forced to detransition. In my view that’s a form of genocide. YMMV
Im kinda confused, as much as I would love title IX to protect trans people, it doesnt. That is in fact one of the big arguments, that trans people should be included in the protected classes from title IX by updating the amendment because currently it does not.
How can you block a law from being used in a way the law isnt used for, thats not blocking, thats just enforcing what the law actually says.. blocking would be if they tried to fix the amendment to include transpeople, as it should, and they said no.
Note, Biden has made no proposal to anyone to actually amend title IX to include trans people... which is what we should be mad at, Biden not proposing that or pushing for it, as that is what he should be doing.
Yes i was half confused. I read this but misubderstoodnit as a reference to the constitution. Itnis kot. Thanks for clarififying.
