IANAL, but
1. everything depends on jurisdiction,
2. generally speaking, mere employees are not responsible for legal activities being impossible
3. size of company will determine who can be held responsible at all (really big companies, basically no one as long as no illegal activity is going on)

Your scenario seems to describe "man power shortage", and that is not illegal and could theoretically be "solved" with either outsourcing or more hiring.
