Instead of #KevinMcCarthy and his band of #BananaRepublicans holding the country hostage over #WorkRequirements for #Healthcare , let's save money by asking Trump-appointed clowns 🤡 posing as federal judges whether their cult beliefs will allow them to approve of any drug BEFORE the #FDA conducts expensive trials! 👉 cnn.com/2023/05/18/health/rsv-

@ChemicalEyeGuy

I mean, it's not up to judges to approve drugs. That's not their function in the US system.

Their job is to rule on whether laws have been properly respected, and in this case the FDA didn't follow the law, which is something the president really should see to.

We should also look into reforming the laws, but in any case that's not up to judges either.

@ChemicalEyeGuy

Well, right, they're different things.

The law is what it is regardless of science, regardless of whether the lawmakers even knew what science is, and judges rule based on law as it is, even if our democratic process lead to really awful, unscientific laws.

That's why we need to push for better laws, not yell at judges for giving us the outcomes that we, through our representatives, set up.

@ChemicalEyeGuy

Well, I'm yelling that we need to reform the laws :)

But so often I see judges doing a good job interpreting bad laws, with lawmakers happy to point fingers at the judges because it relieves them of the responsibility for the laws that they themselves might have passed.

We should not let them get away with that, though.

The current circus around the FDA is a great example. We should be yelling at Biden to follow the approval laws and settle this whole thing, but he gets positive press for pointing fingers at courts.

@volkris The #FDA was the first of its kind in the world, and has saved millions of lives and improved the lives of billions in countries that have followed our example.

Yes, I agree that laws need constant reforming, particularly as #science continuously evolves.

What we should not tolerate is judges subjectively interpreting flawed laws based on their own cultish and often cult-based beliefs. If #Congress will not #ImpeachFederalJudges that can’t be objective, we should recall them.

@ChemicalEyeGuy

So what specific interpretation do you believe this judge got wrong?

@volkris Among other things, he said #mifeprestone was “unsafe”. The #MAGA cult clown 🤡 judge has absolutely no training to overrule the world’s leading experts on this. Additionally, his cult associations severely impair his judgment in this area.

@ChemicalEyeGuy

If you're talking about the ruling out of Texas, I'm searching for the word "unsafe" and not finding anywhere that the judge said the drug was unsafe.

Where did he say it was unsafe, if this is the ruling you're referring to?

fingfx.thomsonreuters.com/gfx/

@volkris ✅ Suggesting that evidence was NOT provided demonstrating that the drug is SAFE, is logically equivalent to calling it UNSAFE.

He is TOTALLY unqualified to make ANY statement about drug safety that overrules experts at the #FDA *and* 20+ years of PROVEN SAFETY!

#SaveAmerica from #BananaRepublicans and #MAGA morons!

@ChemicalEyeGuy

That's not how the law, or the courts, work.

Again I ask, please quote from the ruling where he made any statement about drug safety that overrules experts at the FDA.

In fact, the judge based his ruling in part on experts, citing them.

For example:
"In February 2000, FDA wrote a letter to the Population Council stating that “adequate information ha[d] not been presented".

@volkris A cultish clown 🤡 in a circus is not the same thing as a qualified judge👨‍⚖️ in a court.

@ChemicalEyeGuy

I'm just still waiting for you to quote from his ruling a part you think was in error.
