@sun I remember when Obama said: "if President does it, it's not illegal". And then turned out he paraphrased Nixon. And it was something like 15 years ago or more. And now they are throwing a fit because Supreme Court says the same thing. They were saying that for longer than I was alive.
I wrote something about how your response made me think for a second, and summarize how I think you're right in the end, but in the context of this thread, I don't think @zaitcev would even care either way :)
@volkris@Hyolobrika@sun I'm not sure we're arguing about anything. From the perspective of law-based society, court decisions can override President's decrees. Moreover, constitutionally Congress is the highest power, while other branches are checks and balances, not vice-versa. But in practice, Congress abrogated its power for decades, letting permanent bureaucracy do whatever they want, and letting President do whatever he wants. So Obama saying "I have a pen and a phone" is important in the sense that it codifies the unchecked power of the executive. Like, for instance, it was unthinkable even in my lifetime that President could run a full-on world war without even as much as AUMF, but it is reality now. All of it is only my view though. I'm very open to other viewpoints, even if I do not often agree.
