@markusl already did that. TechSoup are actively hostile to that idea, as it undermines their profit-driven business model (they have no real interest in helping the nfp sector, just profiting off them). And yeah, you might be right that the horse has already bolted re nfps making smarter decisions about tech. Because of this: https://davelane.nz/darkage
@lightweight @markusl follow the money, always.
@lightweight @markusl (To be clear, I am not claiming that the understanding of these concepts is correct, yet. But there is some progress in the right direction.)
@lightweight @markusl gov, intergov orgs, ngos/npos, cso's, etc. work is centered around 2 terms right now: digital public infra and digital public goods, e.g., https://github.com/DPGAlliance/DPG-Standard
@downey @markusl sadly, here in NZ there's almost no understanding of anything digital within gov't. There's no real evidence of any technologists involved in policy development (I just submitted this: https://davelane.nz/suggestions-aotearoa-new-zealands-digital-strategy)
@lightweight @downey @markusl And I submitted: https://adrian.geek.nz/digital-strategy-letter
@alcinnz @lightweight have you all seen https://www.whitehouse.gov/sites/whitehouse.gov/files/omb/memoranda/2016/m_16_21.pdf before? (not saying it's great)
@lightweight @alcinnz I don't know the specific policy origins, but I have seen enough evidence to shift away from that specific view -- mostly that a lot of young people haven't really heard the FS term. for DPG's we have tried hard to push for copyleft by default to reduce the exploitation opportunity.
@lightweight @alcinnz Many years ago at OSCON Danese Cooper gave a talk with a phrase I have (with permission) reused since with these types of folks: copyleft is the only viable license strategy if you need to ensure 'evergreen openness'.
@downey @lightweight @alcinnz As musicians and media artists the concepts of copyleft / cc are incredibly interesting for us.
@downey @zleap @wizard @lightweight @alcinnz @conservancy The @fsfe is providing some voluntary guidance on Free Software licensing/copyright (no legal advice though) per its License Questions team: https://fsfe.org/activities/licence-questions/
@downey @zleap @lightweight @alcinnz @fsfe @conservancy It is precisely this "fairly short list of lawyers who have #FLOSS expertise" that we need to find.
However, to make it more complex we need to:
1. Find attorneys with knowledge of EU law.
2. Find attorneys who know something about copyleft/CC specifically as it relates to music and video.
@downey @zleap @lightweight @alcinnz @fsfe @conservancy
An alternative would be an EU attorney who knows about the Entertainment industry and also copyleft / CC.
Although we are FOSS advocates who use FOSS apps what we create is open culture friendly music, art, music videos and literature.
In our research we've found far more support for FOSS software than open culture art.
Our team has put together a little money to pay for the consultation.
All recommendations appreciated.
@downey @zleap @lightweight @alcinnz @fsfe @conservancy
Example: Imagine we want to provide other artists access to the multitracks for our music (the musical source code in software terms) to build their skills faster, remix and learn from.
Now imagine that a big entertainment company like Netflix wants to licence some of our music for a TV show.
Even if we like the TV show we don't want the big entertainment company to be able to use it for free.
@downey @zleap @lightweight @alcinnz @fsfe @conservancy
The same example goes with Music Videos, Stories and pro-Open Culture Short Films that our collective creates.
This is an awesome website:
https://creativecommons.org/choose/
but we don't want to simply create a licence only to discover that our works are not property protected from being exploited by giant corporations because we didn't consult an attorney.
Our art and its artistic source code free and open to the people, not mega corporations.
@downey @zleap @lightweight @alcinnz @fsfe @conservancy
Another example: Imagine another artist under contract to a music publishing company steals our work and and pretends it's theirs.
The Internet works on algorithms so we receive copyright strikes for "pirating" the corporations art when we were the actual creators. But the anti-piracy algorithms take their side.
They have the powerful attorneys and our arts collective doesn't so
@downey @zleap @lightweight @alcinnz @fsfe @conservancy
our Open Culture work becomes censored and we're framed as pirates with our own work!
Punished for doing good and being pro-Open Culture artists.
We can't afford to get this wrong.
That's why we need smart pro-Open Culture attorneys on our side.
@zleap @wizard @lightweight @alcinnz @fsfe So @conservancy is based in the USA but they aren't really in the business of providing legal consultations. Such stuff usually ends up as a specific hiring/engagement/pro-bono help from a fairly short list of lawyers who have #FLOSS expertise.
