@GottaLaff Cannon would probably be happy to have it restored with another judge. She's curried favor with TFG and doesn't have to deal with something she's clearly not qualified to do. No down side for her.

3/ Andrew Weissmann:

Jack Smith files his appeal brief seeking to reverse Cannon and reinstate the case. He files a day early, and uses no adjectives or adverbs or histrionics- he doesn't need to as he has the facts and law completely on his side. The brief is a devastating refutation of Cannon, who was reversed twice already by the 11th Circuit appeals court. 3 strikes and is she out? Smith does not ask for that relief (yet) - but the court cd order it nonetheless.

Smith's Office calls out the absurdity of Cannon's ruling that DOJ can't appoint or fund special counsels:

"If the Attorney General lacks the power to appoint inferior officers, that conclusion would invalidate the appointment of every member of the Department who exercises significant authority and occupies a continuing office, other than the few that are specifically identified by statute."

In an edited volume with 12 authors, one author's responses to my queries were so rude, I had to close the file.

Now what? Give him what he wants and let that one chapter be filled with the errors he's insisting on stetting, or hold the line for quality?

I'll ask the in-house #editor but it's almost guaranteed this jerk gets his way b/c it's the path of least resistance.
