@Strandjunker The constitution passes that off to congress, which in turn must vote explicitly to define the number of judges. It used to be 6, now its 9.

Abortion rights are set by the states, which is exactly how the constitution is designed to handle things not addressed int he constitution, either congress needs to address it or it passes on to the states.
