Why are real estate listings allowed to photoshop in actively burning fires in the fireplace if it has been declared decorative and sealed/capped by the homeowner?

Update: So we're going for a house that has said decorative fireplace. At least the realtor for the listing was honest and didn't try photoshopping in some fire.
