It always was. It's just that racial education in the USA has influenced people to react in bizarre ways to the point of becoming the "evil" it was trying to prevent.

Tbh idk how the hierarchy is organised but the issue doesn't lie there. One generally issue is the human decision making process and it can't be solved, it can only be mitigated. A more democratic process could maybe help or not depending on the context.
As for this particular case I do not think that people who imposes coc based on the Contributor Covenant are transparent/honest themselves or at least self aware of their own actions.
