Trump just declared it himself, regardless of what the law said. That's the entire dispute here.

Had Trump strongarmed the GOP (well, Congress, whatever) to enact a ban, this wouldn't have been an issue.

The problem is that Trump acted in violation of law. The called him on it.

@volkris I did misremember how it was done. I don't think that banning a weapon like that through ATF reinterpretation of a rule they invented earlier in the decade is problematic. Obviously the right wing justices did. Why I want to outlive all of their tenures on the court and hopefully see their replacement with more reasonable people so we can start returning to some sense of normalcy on things like reproductive rights, gun control regulations, etc.

@hankg the ATF wasn't reinterpreting a rule they invented. It was reinterpreting a law passed by the legislators we elected.

The job of the Supreme Court is ABSOLUTELY not to be reasonable. That's the job of the people we elect to Congress, primarily.

If we elect and reelect lawmakers making unreasonable laws, well, we should knock that off.

The job of the Court is to respect that we apparently want unreasonable laws.

That's democracy for ya.

I'm sick of watching the present SCOTUS throw all manner of precedent, procedure, standing, etc. to the win when it's time to make it difficult to impossible to implement gun control regulation even the likes of which we had until recently, take away reproductive health choices for women, allow hyperpartisan gerrymandering at the state level to benefit Republicans, etc. etc. and then go "oops we just call balls and strikes." Uh huh, that's what they are doing, sure Jan. That in fact is the exact opposite of what they are doing. What's worse is the way they are doing it is making it difficult to impossible to even accomplish these things legislatively. So now the bar isn't just winning sane majorities in congress and the POTUS but constitutional amendments. Yeah, fuck that noise dude. "It's just facts" Puhleaze...
