Elon Musk’s “department of government efficiency” (Doge) program is expected to be sued within minutes of Donald Trump being sworn in.

The 30-page lawsuit, obtained by The Washington Post, challenges the legality of the government advisory committee Donald Trump claims he’ll create, by alleging it violates federal transparency rules on disclosure, hiring and other practices

@didgebaba but at this point this is filing a suit against something that doesn't exist. It's just as nonsensical as the DOGE itself.

It's one PR stunt building on another PR stunt, and we need to be clear about how silly this all is.

@volkris The case is based around the Federal Advisory Committee Act, which was put in place in 1972 and is supposed to be followed when an agency seeks consensus advice from a group that includes at least one person who isn’t a regular federal employee and gets input for its own operations or activities.

The suit also states advisory committees “have a nondiscretionary duty to ‘not be inappropriately influenced by the appointing authority or by any special interest,’” and the plaintiffs argue Trump and others have “inappropriately influenced” the committee.

@didgebaba but that's in line with what I'm saying, agencies have not sought consensus advice from the group, and the group itself barely exists in the first place.

So it's a hollow suit at this point. Maybe in the future there will be some substance, but for now it's just symbolic.
