So has he released the source to his version as demanded by the license ? Seems based on his no as you can't just pick / choose what parts you comply with.
If nothing else, we can use this as a teaching resource an example of a breach of licensing terms.
Usually you get asked about copyright infringement, but I try and add in to using computers legally - use of copyleft, creative commons GPL etc
