Microsoft, under oath, admits the possibility that EU‑hosted data can be accessed by US agencies without any notifications

In sworn French‑Senate testimony, Microsoft’s legal chief for France(M. Anton Carniaux) conceded he cannot guarantee that data on French citizens stored wholly in EU Microsoft datacenters is safe from U.S. silent access and acknowledged that French or any EU authorities might not even be notified if access occurs.

Delivered under oath, this statement is an official legal recognition of the silent‑access risk inherent in relying on Microsoft’s infrastructure.

I agree, in this current climate of mis / disinformation, we need to make statements that are backed up with credible cited sources, so yeah a court document or something.

We can then share far and wide.

Yes you are right, Microsoft can not guarantee that any french data located on their servers even those located in France is safe, and on any US request MS should deliver our data to them.
Anyone who cares about his/her data should not leave it on MS facilites, but for french corrupted government this does not seem a problem.

@amirbkhan @zleap @kuba @devopscats @Endof10 After listening to the whole thing: yes the US Government can access your data under some conditions (there were not given here) and there is no trusted 3rd party that will notify you of such things.

They say it has never happened but that is it. And they also mention reports of transparency done by them (at this point they could make an advert) and that if that was to happened they would notify the client (no mention of when that would occur).

So after the bullshit until minute 16, they start the real answer, but the most interesting is minute 19:30, where Microsoft answers they will resist, but if there is a legitimate request (and there is no explanation what is a legitimate request or not) they will transmit data to the US government. They ensure it never happened yet lol.
