While people have the right to free speech and free expression, that right comes with the demand we are responsible for what we say / write / do etc. So perhaps in this case, an employer also has the right to sack you for saying or writing something homo/trans phobic. The victim(s) also have the right to complain. Linehan clearly knows what he is saying, has been told it is not really acceptable, so has been warned.

Surely a lot of this could easily be dealt with, using existing policies, procedures, codes of conduct and laws.

Common sense should tell the police they don't need to take a heavy handed approach to deal with it, perhaps that should be saved for dealing with theft, burglary, rape and violent crime and other crimes that seem to be plaguing cities such as London on a hourly basis.

If the government want to really deal with abuse, then perhaps these new worker rights laws, need to be written with specific clauses that if you do, say, write certain things, you can be sacked with due process, otherwise the employer can be sued by the victim. Employers have this right, but those rights need to be backed up in law.

That way, people such as Linehan can find themselves unemployable with only themselves to blame.
