Curious about the ramifications of the recent #303CreativevElenis #SCOTUS decision. Does it mean that I, as an atheist website designer, can refuse to create wedding websites with religious references? (This would not be based on the actual religion of the partners, only the content of the site.) Or what if I want to create websites for only same-sex couples? Must I have a sincerely-held religious belief to this effect or can I simply exercise my #FirstAmendment #1A right to not speak in certain situations?

#NeilGorsuch, for the majority, writes “It is difficult to read the dissent and conclude [the majority and the dissent] are looking at the same case.” Gorsuch attributes this reaction to the dissent wildly misreading the facts and the law. Another day, another #SupremeCourt decision I have now read with care and will try to shed some light on. This time it is #303CreativevElenis, available at supremecourt.gov/opinions/22pd. By a 6-3 majority, the Court holds that a business that holds itself open to the public may deny its services to LGBTQ people if the business’s activities are “expressive”. A thread. 1/

(Via SCOTUSblog) Starting today at 10AM Eastern, the Court 'will revisit a long-simmering tension between legal protections for LGBTQ people and the rights of business owners who oppose same-sex marriage. The case, 303 Creative v. Elenis, is a challenge by a Colorado website designer to a state law that bars businesses that are open to the public from discriminating against gay people or announcing their intent to do so. The designer, Lorie Smith, argues that subjecting her to the law would violate her right to free speech.
