@freemo We've certainly been in a murky place approaching it for a while, but this is the first time we've crossed the line since J6, imo.

I would need to review the case more to have an opinion here.. But the blurb doesnt give me enough to go on.. I mean I hate Trump and certainly am happy of any news to keep him off hte ballot and just generally sad if that is overturned. But if this honors the constitution and laws is another matter, I'd have to review the case to say.

My only thought is, how can a local judge keep him off the ballot constitutionally if he hasnt been impeached and barred from office. I would need to know the state laws but that usually needs to be done by a senate not a judge as I understand it.

@freemo States are responsible for running elections and the judicial branch is responsible for making sure the other two branches adhere to the law. So, under that system we use, state judges would absolutely have the power to enforce this constitutional provision.

Is your concern and constitutional violation that US supreme court overruled the states decision rather than it being determined by the supreeme court of the state itself?

From the blurb I assumed it was the states supreme court not the federal supreme court that made this determination, but I didnt read the article.

@freemo No, my concern is that SCOTUS just prevented the constitution from being upheld based on a rule that doesn't apply to any other part of the constitution.

@LouisIngenthron Ahhh ok so you basically thing SCOTUS interpreted the constitution inaccurately.... that could be, I'd need to understand the ruling better to have an opinion.

@freemo Correct. And apparently a lot of constitutional law professors agree. This ruling doesn't seem to be consistent with anything.
