Defence should have got them suppressed as tainted evidence if the arrest was not lawful. Using the dumpster probably gave them just enough cause to get away with it.

In all actuality everything after "place your hands behind your back" should be suppressed and inadmissible in court according to case law, example;
Marsh v. Alabama
"All rights protected under the Constitution extends to private property when that property is used in a public capacity"
That was an unlawful detainment and arrest.

@susanmcshane476 not sure those ever existed...Im 60 and my father was always harrassed by the police in the early 60's just because of his last name. they would come to my grandpas house in the middle of the night and drag him off to the police station only to release him the next day...just for the fun of it. happened over and over.

Yes I have seen New Zealand cops literally roll up their sleeves and help push start a stranded car, after warning the driver that his tag was expired and only advising that he not wait too long to renew it.
Or give a lift to visiting backpackers found hitch-hiking on the motorway (freeway) instead of citing or arresting them.
