Patagonia sues Gap for Trademark infringement.

Patagonia alleges that Gap copied its iconic pocket flap design: rectangular logo with a mountain silhouette above the pocket flap, introduced in 1989.

Patagonia claims that Gap’s actions “confuses shoppers into believing it made the jackets” or let Gap “use its trademarks.”

The similarities here are glaringly clear. But *ideas can’t be trademark. So does this come down to the *idea of a pocket flap on the left side with a “mountain” logo?

Patagonia is suing the Gap for trademark infringement over these maybe-the-logo-was-a-step-too-far fleeces. Patagonia v. The Gap, No. 22 cv 7437 (NDCA Nov. 22, 2022). If you think this is interesting, I have an article coming out this week in Trademark Lawyer Magazine on the controversy.

Me and my supervisor are looking at running a conference in June 2023 in Birmingham (UK) on "Pirates, Ports, and Exports" which covers a variety of maritime themes between c.1500 and c.1800. Does anyone know of any groups/bodies which may be interested in funding such a conference?

I just finished a full draft of the manuscript for my second book, "The Memory of '76: The Revolution in American History," which explores how Americans have redefined and fought over the meaning of the Revolution from 1790 to 2001.

It's meant to get you past the news paywalls. The problem with these micropayment schemes is that they pass on far too much complexity & mental overhead to people who just want to fuck around online.

"Oh, that's an interesting article! I better go re-charge my Post points!" is not a thing that will happen except in poorly put together slide decks.

I can imagine some kind of setup like EZ-PASS (E-ZPASS?) has, where you give them your CC# and they charge you for $25 worth of Points every time you run out.

Will people put up with that? (No fear you'll accidentally run up charges accidentally driving down highways and crossing bridges; significant fear you'll accidentally spend lots of money just clicking around.) Hard to say!

Yep, just the web UI in Chrome under Windows and ChromeOS, and whatever it is that happens in Android :) which I guess is one of those fancy PWA things but really just the web UI too. Seems a pretty common usage pattern!

If you're looking for centralized, ethical Mastodon alternatives, Cohost is a much more interesting project to give a second look.

Are these Points things that you spend to post things yourself, or things that you spend to get access to premium content of some kind? (Those "publishers" that the founder was all excited about?)

I kind of suspect the latter, and okay I guess? I'm not against journalists getting paid. But I'm not sure it's going to catch on somehow... :P

#PSA for all my #trans people:
The super-helpful browser extension Shinigami Eyes seems to have added Mastodon support!! It's not mentioned on the homepage right now, but my #Firefox extension has it in the release notes :_gaysparkle:

If you're not familiar, It highlights known trans-friendly user @'s in green, and transphobic ones in red.

It was invaluable on Twitter, and while Mastodon can be a safer space for some people, I thought everyone would like to know!

Here's an original (circa 1904) rotary AC-DC converter providing power to the (former) IRT subway in NYC. It still works, and is occasionally pressed into service during times of peak load, though most of the system now uses solid-state converters. It is very loud.
