At what point did anyone in this conversation say or suggest sex doesn't refer to a person's genes or genitals? Not me, read again.
What i said is that when we speak we use linguistic gender. We assign he and she to things irrelevant of its sex and only to its gender.
I also said that male and female are terms used to describe both gender and sex separate. Depending on context will determine which you use. If you are a doctor or otherwise talking explicitly about someones genitals you will use sex, however in the vast majority of situations when we speak we are using gender on a day to day basis, as has always been the case.
Yes though that is another matter. If you are going to force someone to speak a certain way in law, then we have a problem. Bigotry sucks but we do not (usually) and should not be trying to make bigotry illegal. It is something we should fight by talking to people and let them know it is unacceptable (As I am trying to do with Casey), but neither I nor any government, has a right to force him to speak a certain way.
